As an international student working in Australia, it is important to understand your rights at work.

Australian workplace laws protect international students in the same way they protect other workers, regardless of whether you work casually, part-time or full-time.

Your Basic Workplace Rights

You have the right to:

• Receive the correct pay for your work, including minimum rates and applicable penalty rates.

• Receive payslips and keep accurate records of your employment and pay.

• Work in a safe and respectful environment, free from discrimination, bullying and harassment.

• Receive appropriate breaks and rest periods under Australian workplace laws and your applicable award or agreement.

• Receive superannuation from your employer if you are eligible.

• Be protected by Australian workplace laws, regardless of your visa status.

 

How Much Can You Work?

If you hold a Student visa (Subclass 500), you can generally work:

Up to 48 hours per fortnight while your course is in session.

You can generally work unlimited hours during scheduled course breaks.

Some students, including those undertaking a master's by research or doctoral degree, may have different work-hour conditions.

Know Your Pay

Australia has a National Minimum Wage, but many jobs are covered by an award that sets minimum pay rates for specific industries and occupations.

Your minimum rate may also vary depending on factors such as:

• your age;

• your job and industry;

• whether you work casually, part-time or full-time;

• when you work, including weekends, nights or public holidays.

As of 1 July 2026, the National Minimum Wage is $24.95 per hour, or $948.00 per week for a 38-hour week. Award rates may be higher. (fairwork.gov.au)

Never assume that being an international student means you can legally be paid less.

 

Payslips & Tax

Your employer must provide you with a payslip within one working day of payday. Keep your payslips and employment records so you can check that you are being paid correctly. (fairwork.gov.au)

If you work in Australia, you will generally need a Tax File Number (TFN). You can apply for one through the Australian Taxation Office.

Your employer will withhold tax from your pay where required. Your tax rate depends on your circumstances and income. (ato.gov.au)

 

Superannuation

If you are eligible, your employer generally must make superannuation contributions for you.

Temporary residents may also be able to claim their superannuation after permanently leaving Australia through a Departing Australia Superannuation Payment (DASP), provided they meet the eligibility requirements. (ato.gov.au)

 

If You Are Injured at Work

Australian workers' compensation schemes can provide support if you are injured or become ill because of your work.

If you are injured at work, report the incident to your employer as soon as possible and seek appropriate medical attention.

Workers' compensation is managed under state and territory laws, so the process and entitlements can vary depending on where you work.

 

Casual, Part-Time or Full-Time?

International students can work in different types of employment.

Casual work generally offers less predictable hours but can provide flexibility around your studies.

Part-time work usually involves regular hours and may provide access to employment entitlements based on your circumstances.

Full-time employment generally involves a standard full-time workload, although your student visa work-hour conditions still apply while your course is in session.

Your employment type can affect your pay and entitlements, so make sure you understand your employment contract and the relevant award.

If you believe you are being underpaid, denied your workplace rights or treated unfairly, you can seek help.
